Terms & Conditions

These Terms & Conditions govern the use of PortfolioSix’s services and website. By engaging PortfolioSix for any design, development, branding, or creative service, you agree to these terms.
1. About PortfolioSix
PortfolioSix is a design agency providing creative and digital services including, but not limited to:
Brand identity and logo design
Graphic and visual design
UI/UX design
Website design and development
Social media design
Marketing creatives
Presentation design
Illustrations and infographics
Packaging and print design
Other custom creative services
The exact scope of work for each project will be agreed upon before work begins.
2. Project Scope
Every project is based on the agreed scope, deliverables, timeline, and pricing.
Any work requested outside the original scope may be treated as additional work and may result in additional fees or changes to the delivery timeline.
PortfolioSix may request clarification, content, references, brand assets, or other materials required to complete the project.
3. Client Responsibilities
The client is responsible for providing accurate and complete information, including:
Project requirements
Text and copy
Images and media
Brand guidelines
Logos and existing assets
Technical requirements
Feedback and approvals
Delays in providing required materials or feedback may affect the project timeline. PortfolioSix will not be responsible for delays caused by incomplete, inaccurate, or late client information.
4. Payments
Payment terms will be agreed upon before the project begins.
Unless otherwise agreed:
A deposit may be required before work starts.
Work may not begin until the required initial payment has been received.
Remaining payments must be completed according to the agreed payment schedule.
Final files or project handover may be withheld until all outstanding payments are cleared.
Payments made for completed work are generally non-refundable unless otherwise agreed in writing.
5. Revisions
The number of included revisions will depend on the project agreement or quotation.
A revision means a reasonable modification to an existing design direction. A completely new concept, direction, or redesign may be considered additional work.
Excessive revisions, changes after approval, or changes caused by new requirements may incur additional charges.
6. Project Approval
The client is responsible for reviewing and approving designs before final delivery or publication.
Once a design has been approved, PortfolioSix will not be responsible for errors that were visible during the approval process.
Additional changes requested after approval may be charged separately.
7. Timelines
PortfolioSix will make reasonable efforts to meet agreed deadlines.
Project timelines may change due to:
Delayed client feedback
Missing content or assets
Changes in requirements
Additional revisions
Third-party services
Technical issues
Circumstances outside PortfolioSix’s reasonable control
Any estimated delivery date is subject to the timely cooperation of the client.
8. Ownership & Intellectual Property
Unless otherwise agreed, ownership of the final approved design will transfer to the client after full payment has been received.
PortfolioSix retains ownership of unused concepts, rejected designs, drafts, working files, internal processes, and proprietary materials unless explicitly transferred through a written agreement.
PortfolioSix may use third-party fonts, stock images, plugins, templates, icons, software, or other licensed assets where required. Such assets may remain subject to their respective third-party licenses.
9. Source Files
Editable/source files are provided only when specifically included in the agreed project scope.
If source files are not included, PortfolioSix may provide the agreed final export formats instead.
Source files requested after project completion may be subject to an additional fee.
10. Third-Party Assets
PortfolioSix may use third-party resources such as stock images, fonts, icons, plugins, software, mockups, templates, or other licensed materials.
The client is responsible for complying with any applicable third-party licensing requirements after delivery where the relevant license is assigned to or purchased by the client.
PortfolioSix will not knowingly provide assets that violate applicable licensing restrictions.
11. Client-Supplied Materials
The client confirms that they have the necessary rights and permissions to use any materials provided to PortfolioSix.
This includes:
Images
Videos
Logos
Fonts
Text
Illustrations
Trademarks
Other intellectual property
The client is responsible for claims arising from unauthorized use of client-supplied materials.
12. Confidentiality
PortfolioSix will treat confidential project information shared by the client as confidential and will not knowingly disclose it to unauthorized parties.
Confidential information does not include information that:
Is publicly available
Was already known to PortfolioSix
Becomes publicly available without breach of these terms
Must be disclosed due to legal requirements
Where appropriate, PortfolioSix may enter into a separate Non-Disclosure Agreement (NDA).
13. Portfolio & Marketing Rights
Unless the client requests otherwise in writing, PortfolioSix may display completed work in its portfolio, website, social media, case studies, presentations, award submissions, and other promotional materials.
Confidential or unreleased projects will not be publicly displayed before the agreed launch date.
Clients who require complete confidentiality should notify PortfolioSix before the project begins.
14. Website & Development Services
For website and development projects, PortfolioSix is responsible only for the features and functionality included in the agreed scope.
Third-party services such as hosting, domains, payment gateways, APIs, plugins, analytics platforms, email services, and external software may be subject to separate terms and fees.
PortfolioSix cannot guarantee uninterrupted operation of third-party services.
Ongoing maintenance, updates, security monitoring, content updates, hosting, and technical support are not included unless specifically agreed.
15. Cancellation
Either party may request cancellation of a project.
If the client cancels a project after work has started, the client may be responsible for payment for work already completed, committed resources, and approved expenses.
Deposits or advance payments may be non-refundable depending on the stage of the project and the agreed payment terms.
PortfolioSix may suspend or terminate work if payments remain overdue or if the client repeatedly fails to provide required information or approvals.
16. Suspension of Work
PortfolioSix may temporarily suspend a project if:
Payments are overdue
Required information is not provided
Feedback is repeatedly delayed
Project requirements substantially change
The project becomes inactive for an extended period
Restarting a suspended project may require a revised timeline and quotation.
17. Limitation of Liability
PortfolioSix will make reasonable efforts to provide professional and reliable services.
However, PortfolioSix will not be liable for indirect, incidental, consequential, or business-related losses arising from the use of delivered designs, websites, or other creative materials.
The client remains responsible for reviewing and approving final materials before publication, printing, advertising, or commercial use.
18. Third-Party Services
PortfolioSix may recommend or integrate third-party services.
PortfolioSix is not responsible for changes, downtime, pricing, security issues, policy changes, or failures caused by third-party providers.
Any third-party subscription or service fees are the responsibility of the client unless otherwise agreed.
19. AI-Assisted Tools
PortfolioSix may use artificial intelligence or AI-assisted tools as part of its creative workflow where appropriate.
AI-assisted tools may be used for research, ideation, image generation, editing, prototyping, copy assistance, or other creative processes.
PortfolioSix will make reasonable efforts to ensure that final deliverables meet the agreed quality and project requirements.
Where a project requires specific restrictions regarding AI-generated or AI-assisted content, the client must communicate those requirements before work begins.
20. Force Majeure
PortfolioSix will not be responsible for failure or delay caused by circumstances outside its reasonable control, including natural disasters, internet or infrastructure failures, government actions, technical outages, cyber incidents, illness, or failures of third-party providers.
21. Changes to These Terms
PortfolioSix may update these Terms & Conditions from time to time.
The updated version will be published on the PortfolioSix website with the revised effective date.
The terms applicable to a project will generally be those agreed upon at the time the project is confirmed, unless otherwise agreed.
22. Governing Law
These Terms & Conditions shall be governed by the applicable laws of the jurisdiction in which PortfolioSix is legally registered, unless a separate written agreement states otherwise.
Any disputes will first be attempted to be resolved through good-faith communication between the parties.
23. Acceptance
By requesting services, approving a quotation, making a payment, signing a proposal, or otherwise proceeding with a project, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
